“Ashley was as mess cook on the Miller.

He and another man were dumping an unusually heavy G.I. can when the ship gave a lurch.

His partner lost his grip on one handle and ASHLEY, either attempting to hold on to the can or being unable to extricate his hand from the handle, lost his balance and fell overboard.

While mess cooks have been instructed in the dangers of working near lifeline in rough weather and some have worn life jackets for their own protection, ASHLEY had none one.

Subsequently all men dumping garbage have been ordered to wear life jackets at all times.”
